Global Contacts Inc. ("CaptchaText" or "CaptchaText.com" or "us" or "we" or "our") provides its CAPTCHA verification service (the "Service") to you through its website located at www.captchatext.com (the "Site"), subject to this Terms of Service agreement ("TOS"). By accepting this TOS or by accessing or using the Service or Site, you acknowledge that you have read, understood, and agree to be bound by this TOS. If you are entering into this TOS on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity and its affiliates to this TOS, in which case the terms "you" or "your" shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with this TOS, you must not accept this TOS and may not use the Service.

The Services We Provide
CaptchaText provides a revolutionary CAPTCHA verification service utilizing our proprietary Zero Database Architecture and Hybrid In-Memory Indexing engine. Our service includes comprehensive bot protection through real-time IP verification, token pool management, and multi-geographic server distribution. The core service is provided free of charge, with optional paid plans available for convenience purposes only.

Service Access and API Keys
When you register for our Service, you will be provided with an API key for your domain. Our system employs advanced domain-binding technology that automatically validates each API request against its originally registered domain. This means that even though API keys are publicly visible, they can only function when called from their specifically registered domains. Any attempt to use an API key from an unauthorized domain will be automatically rejected by our system. Each API key is strictly bound to its original domain through our proprietary validation system, ensuring security without requiring key confidentiality.

Free Service and Premium Features
Our core CAPTCHA verification service is provided completely free of charge as part of our commitment to making the internet more secure. The free service encompasses our entire security infrastructure, including our advanced Zero Database Architecture, Hybrid In-Memory Indexing engine, and comprehensive bot protection systems. Users of the free service enjoy unlimited traffic handling capabilities, unrestricted evaluation counts, and full access to all security features without any artificial limitations.

The free service includes regular access to our global server infrastructure, real-time IP verification against our continuously updated database of over 200,000 malicious IPs, and support for 23 languages. Free users can configure token pool sizes up to 1000 concurrent tokens for high-traffic scenarios, and utilize all available customization options including themes, sizes, and positioning features. The only requirement for free service users is a simple manual renewal process every 30 days through our website interface. This renewal process helps maintain active domain verification and ensures continued service quality for all users.

Paid plans are available as optional convenience enhancements to the base free service:

⠀ The Prime Plan eliminates the need for manual renewals by providing automatic subscription renewal capability. This plan is designed for users who prefer uninterrupted service without the need for monthly manual renewal actions.

⠀ The Elite Plan includes all Prime Plan features and additionally removes CaptchaText branding from the verification interface. This plan is ideal for users who prefer to remove CaptchaText branding and backlinks from the CAPTCHA interface, though it should be noted that this is limited to brand removal only and does not constitute a complete white-label solution.

It is important to note that paid plans do not provide any additional security features or higher levels of protection, as our commitment is to provide the same enterprise-grade security to all users regardless of their subscription status.

Multiple Currency Payment Options
All prices displayed on CaptchaText's website are based on United States Dollars (USD). While we offer multiple currency display options for your convenience, please note that USD prices are fixed and other currency displays are approximate. Currency conversions are calculated periodically and may not reflect real-time exchange rates. All billing and payments are processed in USD regardless of the displayed currency. Any price differences due to currency exchange rates cannot be refunded.

Refund Policy
Due to the immediate activation and provision of paid convenience upgrades, all payments made for any paid services are strictly non-refundable from the moment they are processed. This no-refund policy applies to Prime, Elite and Custom plan subscriptions. Paid convenience upgrades are activated with immediate effect upon receipt of payment and cannot be reversed. These services will continue until the end of the subscription term with no possibility of refund or cancellation.

Given the instant activation and convenience-oriented nature of our paid upgrades, we do not provide refunds once payments are processed,
including but not limited to:

⠀⠀ Automatic renewal payments
⠀⠀ Changes in service requirements
⠀⠀ Mistaken subscription purchases
⠀⠀ Any other circumstances after payment processing

You acknowledge and agree that by purchasing any paid upgrades, you understand and accept this no-refund policy. We encourage all users to carefully consider their needs before upgrading to any paid upgrades, as all purchases are final and binding.

To understand this no refund policy with an example: Imagine you purchased a monthly transit pass at 9:00 AM. By 9:01 AM, all the automatic systems are configured - your pass is activated, registered in the transit system, and ready for unlimited use. Even if you change your mind at 9:02 AM, the convenience of unlimited use has already been set up and activated. The transit authority cannot 'undo' the fact that your pass was registered and activated in their system. Similarly with our paid convenience upgrades - the moment you pay for Prime, Elite or Custom plans, our system instantly configures your account for either automatic renewals or brand removal. These system configurations are immediate and irreversible, as they take effect in real-time across our entire service infrastructure.

Account Security and Credentials (for Paid Users)
When registering for our paid Service upgrades, you must provide accurate and complete information throughout the registration process. As a paid service user, you assume sole responsibility for the security and management of your account. This responsibility encompasses maintaining the security of your account credentials, monitoring and taking responsibility for all activities that occur under your account, and immediately notifying us of any suspected unauthorized access or security breaches. You are also required to ensure that your contact information remains current and accurate at all times, as this is essential for account-related communications and billing purposes. Additionally, you must implement and maintain appropriate security measures on your own systems to prevent unauthorized access to your account and to protect your integration with our Service. Failure to maintain these security standards may result in account suspension or termination.

Intellectual Property Rights
All rights, title, and interest in the Service, including all intellectual property rights, remain exclusively with CaptchaText. This includes, but is not limited to, our source code, object code, algorithms, processes, user interface designs, system architecture, infrastructure, documentation, guides, trademarks, and logos. These intellectual property rights encompass all aspects of our service delivery, security mechanisms, and proprietary technologies that make our CAPTCHA system unique and effective.

You receive only a limited license to use the Service as provided, subject to strict limitations. You are expressly prohibited from modifying or creating derivative works, reverse engineering or decompiling our code, copying or replicating our features, removing any proprietary notices, transferring or sublicensing the Service to others, or using the Service for any unauthorized purposes. Additionally, any feedback, suggestions, or improvements you provide regarding the Service may be used by us without any obligation to you. This includes incorporating your suggestions into our Service improvements or using your feedback for service enhancements without compensation or attribution.

Service Availability
Our core infrastructure is distributed across multiple geographic locations, with automatic failover capabilities and redundant systems to ensure maximum uptime. We will endeavor to provide the Service 24 hours per day, 7 days per week throughout the calendar year. However, you acknowledge that due to the nature of servers and internet technology, occasional unavailability of the Service cannot be avoided. Service interruptions may occur as a result of scheduled system maintenance and upgrades, emergency maintenance procedures, equipment malfunctions, hardware failures, network or telecommunications disruptions, Distributed Denial of Service (DDoS) attacks, internet service provider outages, database maintenance, or traffic spikes exceeding normal patterns.

While we implement industry-standard monitoring systems to detect and respond to service disruptions quickly, we do not guarantee uninterrupted access to the Service. We maintain a target uptime of 99.9%, excluding scheduled maintenance windows. In the event of any significant service disruption, our technical team will work to restore service operations as quickly as possible and provide status updates through our designated communication channels.

Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms to the extent such failure or delay is caused by conditions beyond its reasonable control. Such conditions include, but are not limited to: natural disasters (earthquakes, hurricanes, floods, fires, or similar events), acts of war, terrorism, or civil unrest, government actions, laws, or regulations that materially affect service delivery, pandemics, epidemics, or public health emergencies, large-scale power outages affecting our data centers, major internet backbone disruptions, labor disputes or strikes, systemic telecommunications failures, extraordinary market conditions or economic disruptions, and any other circumstances beyond reasonable control that make performance commercially impracticable.

The party affected by such Force Majeure event shall provide prompt written notice to the other party of the nature and expected duration of the Force Majeure event. The affected party must use commercially reasonable efforts to mitigate the effects of the Force Majeure event and resume performance as soon as reasonably possible after the resolution of the event. If a Force Majeure event continues for more than thirty (30) consecutive days, either party may terminate these Terms upon written notice to the other party, without incurring any penalty or further obligation beyond those accrued prior to termination.

Service Implementation Terms
If you integrate our Service into your platform or service ("Integrator"), you acknowledge and agree to certain core responsibilities. As an Integrator, you maintain full responsibility for your implementation of the Service, including maintaining appropriate security measures on your platform. You must strictly comply with our implementation guidelines as provided in our documentation. Any modification or alteration to the CAPTCHA user interface is prohibited without explicit permission from CaptchaText. Furthermore, you are required to ensure that your usage of our Service aligns with our acceptable use policies at all times. Failure to comply with these requirements may result in immediate termination of service without notice.

Usability and Accessibility
The Service provides CAPTCHA challenges in multiple languages to accommodate a diverse user base. However, we cannot guarantee that all users will be able to successfully complete these challenges due to various factors including, but not limited to, language limitations, visual or auditory impairments, or technological constraints. While we currently support 23 languages, you acknowledge that users speaking unsupported languages will receive challenges in English by default.

You expressly agree that CaptchaText shall not be held liable for any losses, damages, or missed business opportunities resulting from users' inability to complete CAPTCHA challenges. This includes, but is not limited to, situations where high-value customers or potential clients are unable to proceed due to language barriers, difficulty in recognizing characters, or challenges understanding audio alternatives. For example, if a user familiar only with Malay language receives an English CAPTCHA challenge and cannot complete a transaction on your website as a result, we bear no responsibility for any consequential losses or damages.

Furthermore, while we strive to maintain accessible verification options through both visual and audio challenges, you acknowledge that certain users may experience difficulties with both formats. We cannot guarantee that all users will be able to successfully complete these challenges, regardless of the presentation method offered, and you acknowledge and agree that it is your sole responsibility to provide alternative means of completing transactions or accessing services for users who are unable to complete the CAPTCHA challenges on your website.

Acceptable Use
You agree to use the Service in accordance with all applicable laws and regulations. You may not use the Service to engage in, foster, or promote illegal, abusive, or irresponsible behavior. You understand that we maintain sole discretion in determining what constitutes acceptable use of our Service. Examples of unacceptable use include, but are not limited to: using the Service for unlawful purposes, attempting to bypass or disable the CAPTCHA verification system, launching automated attacks or scripts against our infrastructure, or engaging in any activity that disrupts or degrades the performance of the Service for other users. We reserve the right to suspend or terminate your access to the Service immediately if we determine, in our sole judgment, that your use of the Service violates these acceptable use terms.

Service Termination and Account Suspension
We maintain the right to suspend or terminate service access, without prior notice or liability, for any reason at our sole discretion, including but not limited to if we determine that your website or services violate applicable laws in relevant jurisdictions. We exercise this right with particular attention to regional legal variations, understanding that certain activities may be legal in some jurisdictions while illegal in others. We maintain sole discretion in evaluating potential legal exposure or conflicts with applicable laws in any jurisdiction where our Service is accessed.

Data Processing and Privacy
Our Service operates on a Zero Database Architecture principle, processing data in accordance with our Privacy Policy and applicable data protection laws. We collect and process only the minimum necessary data required for Service operation, including IP addresses for verification, token management data, and technical logs. It is crucial to understand that our CAPTCHA service functions solely as an initial verification gateway and does not process, store, or have access to any form of data submitted through your website's forms or systems. This includes, but is not limited to, user input, form submissions, payment details, or any other sensitive information processed on your website.

To be explicitly clear: CaptchaText acts only as a preliminary security check before data submission to your systems. Once a CAPTCHA verification is completed, any subsequent data processing, storage, or security measures are entirely your responsibility. We cannot and do not accept any liability for data breaches, security flaws, or any other issues that occur within your website or server systems. Your website's overall security, data protection measures, and compliance with privacy regulations remain solely your responsibility. Our service is limited to providing the initial CAPTCHA verification, and we maintain no access to or responsibility for any data processed through your website's forms or server systems.

Affiliate Program Terms
CaptchaText offers an affiliate program that allows individuals and organizations to earn commissions by promoting our service. Affiliates receive a 25% commission on first-time purchases referred through their unique affiliate links. The program operates under its own specific terms and conditions, which govern commission structures, payment terms, promotional guidelines, and other program-specific requirements. Our affiliate program maintains strict quality standards and ethical marketing practices to ensure the integrity of our service. By participating in our affiliate program, affiliates agree to be bound by both these general Terms of Service and the specific Affiliate Terms of Service. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. If a provision is deemed invalid or unenforceable, the parties agree to negotiate in good faith to modify the Terms to effect the original intent of the parties as closely as possible in a mutually acceptable manner. The invalidity of any part of these Terms shall not impair or affect the validity or enforceability of the rest of these Terms. If any provision is declared invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified or eliminated solely to the extent necessary to address such invalidity or unenforceability, while the remainder of the Terms shall remain in effect.

Indemnification
If CaptchaText is sued or threatened with a lawsuit from a third party because of your use of the Service, you agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party. You agree to reimburse CaptchaText for what it pays to satisfy a judgment or settle a case, including reasonable attorney's fees and all other costs CaptchaText incurs in defending itself.

Disclaimer of Warranties
CAPTCHATEXT EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE SERVICE, BEING PROVIDED FREE OF CHARGE AS A PUBLIC SERVICE INITIATIVE TO ENHANCE INTERNET SECURITY, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CAPTCHATEXT MAKES NO WARRANTY THAT (i) ITS SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, (ii) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS, OR (v) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

ANY MATERIAL LINKED, ACCESSED, OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, WEBSITE, OR BUSINESS OPERATIONS THAT RESULTS FROM THE USE OF THE SERVICE OR THE ACCESS OF ANY SUCH MATERIAL. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CAPTCHATEXT OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE, INCLUDING ANY THIRD-PARTY INTEGRATIONS OR IMPLEMENTATIONS, IS AT YOUR SOLE RISK. CAPTCHATEXT DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, ABILITY TO PREVENT ALL AUTOMATED ATTACKS, OR OTHERWISE. THIS DISCLAIMER OF WARRANTIES APPLIES TO ALL USERS, WHETHER USING THE FREE SERVICE OR PAID CONVENIENCE FEATURES, AS THE FUNDAMENTAL SERVICE ARCHITECTURE REMAINS THE SAME FOR ALL USERS.

Limitation of Liability
RECOGNIZING THAT CAPTCHATEXT'S PRIMARY MISSION IS TO SERVE THE PUBLIC INTEREST BY OFFERING FREE CAPTCHA VERIFICATION SERVICES FOR THE BETTERMENT OF INTERNET TECHNOLOGY AND SECURITY, AND ACKNOWLEDGING THAT ANY PAYMENTS MADE BY USERS FOR CONVENIENCE FEATURES ARE UTILIZED TO SUSTAIN AND ENHANCE THIS FREE SERVICE MODEL, IN NO EVENT SHALL CAPTCHATEXT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE. DUE TO THE FREE SERVICE ARCHITECTURE MODEL OF CAPTCHATEXT, YOU EXPRESSLY AGREE THAT ANY COURT-ORDERED PENALTIES, FINES, DAMAGES, OR ATTORNEY FEES ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD IN TOTAL, REGARDLESS OF THE NATURE OR NUMBER OF CLAIMS. THIS LIMITATION APPLIES EQUALLY TO BOTH FREE AND PAID USERS, AS PAID FEATURES ARE SOLELY CONVENIENCE ENHANCEMENTS THAT SUPPORT THE SUSTAINABILITY OF OUR FREE SERVICE MISSION.

Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Reno, NV, U.S.A., and you hereby consent to the jurisdiction of such courts.
